Privacy policy

Nesabel Online ("we," "us," "our") is committed to protecting your personal data in compliance with the Data Privacy Act of 2012 (RA 10173) and its Implementing Rules and Regulations. This Privacy Policy explains what personal data we collect, why, how we use and protect it, and your rights as a data subject.

2. Personal Data We Collect

We collect the following categories of personal data:

  • Account information: full name, mobile number, and email address.
  • Delivery information: delivery address, recipient name, and recipient contact number.
  • Payment information: we do not collect or store your payment card or e-wallet details. Payments are processed via bank transfer, payment on delivery (cash only), and payment on pick-up.
  • Loyalty program data (Nesabel Customer Card): purchase history and shopping preferences, used to personalize offers and track rewards.
  • Marketing preferences: your consent status for SMS, Facebook Messenger, and Viber promotions.
  • CCTV footage: captured at our stores/warehouses for security purposes.
  • Cookies and technical data: collected via our Shopify-hosted website (see Section 5).

3. How We Use Your Data

We use your personal data to: process and fulfill orders; arrange delivery; manage your account and the Nesabel Customer Card loyalty program; provide customer service; send order and delivery updates; send marketing communications (where you have consented); maintain store security via CCTV; and comply with legal and tax obligations.

4. Legal Basis for Processing

We process your data based on: (a) your consent (e.g., marketing communications, loyalty program enrollment); (b) the necessity of processing to fulfill our contract with you (e.g., order and delivery data); and (c) our legitimate business interests (e.g., fraud prevention, store security via CCTV), balanced against your rights.

5. Cookies

Our Site runs on the Shopify platform, which uses essential cookies required for the Site to function (e.g., cart, checkout, security) as well as Shopify's own analytics and functionality cookies. We do not currently use third-party advertising cookies beyond those built into Shopify. You can manage cookie preferences through your browser settings, though disabling essential cookies may affect Site functionality.

6. Sharing With Third Parties

We share personal data only as necessary with:

  • Shopify, our e-commerce hosting and payment-processing platform, which processes data on our behalf under its own privacy and security terms.
  • Delivery partners/couriers, including third-party riders or courier services you may select, who receive your name, contact number, and delivery address to complete delivery.
  • Customer service channels (Facebook Messenger, Viber, SMS, email), used solely to communicate with you regarding your orders or inquiries.

We do not sell your personal data to third parties.

7. Marketing Communications

With your consent, we may send promotional messages via SMS and Facebook Messenger/Viber. You may opt out at any time by replying "STOP" to SMS messages, blocking/muting our Messenger or Viber account, or contacting our customer service team. Opting out of marketing may affect transactional messages related to your orders.

8. CCTV Notice

For security purposes, our physical stores and warehouses are monitored by CCTV. Footage is retained for a limited period and may be accessed by authorized personnel or law enforcement when necessary. Signage is posted at monitored premises as required by law.

9. Children's Data

While we welcome family shoppers, our alcohol and tobacco products are restricted to customers 18 years old and above. Where a minor's information is processed (e.g., as part of a family account created and managed by a parent or guardian), we rely on the parent or guardian's consent, and we do not knowingly collect personal data directly from unsupervised minors for marketing purposes.

10. Data Retention

We retain personal data only for as long as necessary to fulfill the purposes described in this Policy, comply with legal, tax, and accounting obligations, and resolve disputes. CCTV footage is retained on a rolling basis per our internal security retention schedule.

11. Data Security

We implement reasonable organizational, physical, and technical safeguards to protect your data, including reliance on Shopify's PCI-DSS-compliant infrastructure for payment processing and restricted access to customer data on a need-to-know basis.

12. Your Rights as a Data Subject

Under the Data Privacy Act, you have the right to: be informed of how your data is processed; access your personal data; correct inaccurate data; object to processing; request erasure or blocking of data (subject to legal retention requirements); data portability; and to file a complaint with the National Privacy Commission (NPC). You also have the right to be indemnified for damages arising from inaccurate, unlawful processing.
